Terms of Service

These terms govern your use of the TouchPoint platform, operated by BeeNerdy OÜ ("BeeNerdy", "we", "us").

1. Description of Service

TouchPoint is a social media management platform designed for agencies and businesses. The platform provides tools for content planning, approval workflows, publishing to Facebook, Instagram, and TikTok, and engagement reporting.

2. User Responsibilities

By using TouchPoint, you agree to:

• Keep your login credentials secure and not share them with unauthorized individuals.
• Ensure that any content published through TouchPoint complies with Facebook, Instagram, and TikTok platform policies and community guidelines.
• Maintain valid authorization for any Facebook Pages, Instagram accounts, and TikTok accounts connected to your TouchPoint account.
• Provide accurate information when setting up your account and connecting social media accounts.

3. Acceptable Use

You must not use TouchPoint to:

• Send spam or unsolicited messages through connected social media accounts.
• Perform automated bulk actions that violate Meta's or TikTok's Terms of Service or Platform Policies.
• Publish content that is illegal, defamatory, or infringes on third-party intellectual property rights.
• Attempt to access other users' data or accounts without authorization.
• Reverse engineer, decompile, or attempt to extract the source code of the platform.

4. Limitation of Liability

TouchPoint relies on third-party APIs provided by Meta (Facebook and Instagram) and TikTok. BeeNerdy is not responsible for:

• Meta or TikTok API outages, rate limiting, or service disruptions that affect publishing or reporting.
• Expiration or invalidation of Facebook page access tokens or TikTok access tokens.
• Content removed or restricted by Facebook, Instagram, or TikTok due to their community guidelines or policies.
• Changes to Meta's or TikTok's APIs that affect TouchPoint functionality.

To the maximum extent permitted by law, BeeNerdy's total liability for any claims arising from your use of TouchPoint is limited to the fees you paid in the 12 months preceding the claim.

5. Termination

Either party may terminate the service relationship at any time with 30 days written notice.

Upon termination:

• Your access to the TouchPoint platform will be deactivated at the end of the notice period.
• All connected Facebook Pages, Instagram accounts, and TikTok accounts will be disconnected.
• Stored page access tokens will be deleted immediately.
• Your content (images, videos, text) created during the subscription remains yours.
• Engagement reports will be available for download for 30 days after termination, after which they will be deleted according to our data retention policy.

BeeNerdy reserves the right to suspend or terminate accounts immediately if the user violates these terms or engages in activity that harms the platform or other users.

6. Governing Law

These terms are governed by the laws of the Republic of Estonia. Any disputes arising from these terms will be submitted to the courts of Tallinn, Estonia.
